§ 1 General

From now on, haefele.fashion will operate an online shop at the internet address www.haefele.fashion

You place all orders via the Website. Our deliveries and services are governed exclusively by the General Terms and Conditions, as applicable when the order is placed. We do not accept any diverging terms and conditions from the customer except where expressly agreed in writing.

The European Commission provides a platform for the out-of-court resolution of disputes (ODR platform), viewed under http://ec.europa.eu/odr

We are not willing to enter into dispute resolution proceedings before the consumer arbitration board. 

§ 2 Contracts

The language is available for contracts in English, German and Spanish.

The products on our Website constitutes an offer by haefele.fashion for a purchase contract.

When submitting the order form provided on our Website, you place a binding offer for a purchase contract with us. You submit a proposal by entering all required information during the ordering process and posting the order form to us using the “complete purchase” button. Before you send your offer, you will be able to view your details and correct any mistakes.

When haefele.fashion receives your order, we will send you an e-mail confirming receipt of your order with the details of your order (order confirmation). Please note that our order confirmation does not constitute a declaration of acceptance of your contractual offer but serves for information purposes only.

A purchase contract between you and haefele.fashion will become effective only after we have accepted the offer by delivering the goods ordered. If payment in advance were chosen as a payment option, the goods would be delivered only after the total amount has been credited to our account.

§ 3 Cancellation 

You may annulment your contract of purchase within 14 days without having to state reasons. 

To use your right to cancel your order, you must inform us, haefele.fashion, at Haupt Strasse 30, Suessen 73079, Germany, e-mail: info@haefele.fashion by sending us an explicit declaration stating that you are resigning your contract of purchase for example: by sending us a letter in the mail or an e-mail.

The cancellation policy applies to consumers under § 13 of the German Civil Code of Law.

It will be sufficient to send us your notification of cancellation within the given cancellation timeframe for the 14-day cancellation timeframe to be granted.

Consequences 

If you cancel your contract of purchase, we will refund the payments that we have received from you, including shipping costs (excluding additional shipping costs that are from a different shipping option, other than the regular standard shipping option that we offer) without delate and within 14 days at most, effective the day that we receive your cancellation.

The payment method used to make the transaction will also be used for the reimbursement unless we have explicitly agreed to something else. Your refund will not be charged. 

We reserve the right to hold the reimbursement until we have received the returned items. You must immediately send the item back to us no later than 14 days after the date you have notified us of the cancellation of this contract. 

If the item is back to us in 14 days, the extended deadline will be granted. You are required to compensate us for any loss in value if the good can be traceable to unnecessary handling, which goes beyond the admissible proofing of the item’s condition, its functionality and characteristics.

Reasons to terminate the cancellation policy 

The cancellation policy is in place if the product you bought has not been customised or altered.

§ 4 Returns right

Your statutory right of revocationhaefele.fashion offers you the following voluntary right of return:

All haefele.fashion products can be returned to us within 30 days of receipt of the products.  However, the right of return applies to unwashed, unworn, defect-free and the tag have not been detached. 

For any loss of value due to wearing, washing, or causing other traces of use, removal of the safety label, damage of the original packaging, accessories, etc., In this case, haefele.fashion will give back to the client without reimbursing the purchase price.

Return of goods

Also, cosmetics, toiletries, certain jewellery and items with a security seal can only be returned if faulty. All goods that are returned will be at our expense if the following provisions are complied with.

All return shipments use the same service as the original delivery (DHL) using the waybill or return sticker enclosed in the original package.  We can only accept returns from the country the shipment was sent to. For instance, if the shipment was sent to Spain, we could only accept a return from Spain. In case of a return, haefele.fashion will reimburse the money to your account or credit card. Losses due to currency change will not be refunded.

§ 5 Prices

1 Gift Card

The Gift Card can be used to purchase any article available on our Website except for additional Gift Cards before its expiration date. Exchanges or reimbursements of your gift card are applicable under the return and withdrawal rights and conditions.

The Gift Card can only be used in the destination country, determined when purchasing the Gift Card.  When purchasing the Gift Card, you may choose between sending the Gift Card by E-mail or regular mail.

Haefele.fashion reserves the right to cancel or block the Gift Card if necessary due to legal reasons, for example, in case of loss or misuse of the Gift Card. You will be informed immediately by haefele.fashion.

2. Promotion Code

Promotion codes have different validity periods and are applicable for purchasing any product available on haefele.fashion, except additional Gift Cards. 

Exchanges or reimbursements of promotion codes, which were part of a marketing promotion or which you may have received on behalf of haefele.fashion, are not allowed.  Haefele.fashion reserves the right to cancel or block the promotion code for legal reasons, such as loss or misuse. You will be informed immediately by haefele.fashion.

Return policy for sales using a promotion code.

Suppose you are returning only one of the items from your order. In that case, the value of the promotion code will be adjusted accordingly, and only the amount relevant to the returned item will be refunded. 

§ 6 Storage of contract data

We store your order data. Also, if you wish to print your order, you may do so. 

Once you have sent your order to us, it will appear “complete purchase” on your screen, and your credit card details have been verified. In addition, you will receive an e-mail order confirmation stating all details entered.

§ 7 Dispatch & Shipping

Your package will be shipped with either DHL, depending on the destination. The goods will be ready for dispatch the day following your order. Delivery will be made within 1 to 8 business days to the customer address. 

The goods will be dispatched only after the total purchase price has been credited to our account.

Deliveries to non-EU destinations                                                                                                                 

Deliveries to non-EU destinations take 1 to 20 business days, depending on the country.  As indicated, the product prices are exclusive of value-added tax and customs duties and German value-added tax. In case of a return, handling fees & customs duties can be refunded as a Gif card.

Deliveries to other destinations to countries liable to customs duties take 1 to 7 business days.  As indicated, the product prices are exclusive from value-added tax and customs duties and complete from German value-added tax. 

Be aware that DHL will charge all import sales taxes, customs duties, and handling charges separately for each country.  Also, note that you will be responsible for any banking charges incurred in foreign countries.

In case of a return, haefele.fashion will not refund the customs duties, import sales taxes, and DHL handling charges.

§ 8 Payment & right of retention

All payments will be handled in the currency chosen for the purchase. If you choose Klarna as a payment method, an email will be sent directly from Klarna to you with an invoice for payment, so keep checking your registered email address. Please bear in mind that if you choose Klarna, they may apply a limit, which can vary for each customer. You can find further information at www.klarna.com  

Payment using a Gift Card

When acquiring using a Gift Card, enter the Gift Card code in the designated field at the end of your purchase. If the amount exceeds the Gift Card balance, please select the payment method to cover the remaining amount. 

If the Gift Card balance exceeds the order amount, you may use the same code for your next purchase. The amount remaining will be available until your credit balance has been used up completely.

Payment using a promotion code

When making an acquisition using a promotion code, enter the promotion code in the designated field at the end of your purchase.  If the order price exceeds the promotion code balance, please select a payment method you wish to cover the remaining amount.

 § 9 Retain title of ownership

The goods delivered remain property of haefele.fashion until full payment has been made.

§ 11 Warranty

Claims based on defects in the delivered items must be governed by the applicable legal provisions, except that any allegation for damages relating to fault must be subject to section 12 liability.

§ 12 Liability

We take unlimited liability for damage caused by neglectfulness. Our liability for ordinary negligence shall be limited to foreseeable damage of the contract. 

We don’t accept liability for any ordinary negligence, which are not an essential obligation. Nothing in this shall injustice our liability in the event of fraudulent concealment of defects or guarantee the quality of claims based on the Product Liability Act.

Haefele.fashion shall also extend to the personal liability of its employees & staff members.

§ 13 Governing law

All legal conflicts arising in connection with a purchase contract must be conducted by German law without the UN Sales Convention.

If any provision is invalid, nothing in this shall prejudice the validity of the remaining provisions hereof.

EU Dispute Resolution Platform

Alternative Dispute Resolution

We do not participate in a dispute settlement procedure before a consumer compensation agency within the meaning of the VSBG and we are not obliged to do so.

Applicable law

These General Terms and Conditions shall be governed by German law.
